Terms and Conditions

All nonprofit organizations that participate in NTX Giving Day must acknowledge and agree to the following rules:

• I certify that my organization will provide supplemental information and supporting documentation to substantiate my organization’s eligibility for NTX Giving Day upon request.
  
  
• I certify that my organization is in good standing with the state of Texas and the IRS, and my organization is not in violation of any applicable local state and/or federal law, ordinance, or regulation. Further, I understand and agree that participation in NTX Giving Day does not constitute endorsement of my organization or mission by Communities Foundation of Texas or any NTX Giving Day partner.
  
  
• I certify that 100% of the proceeds my organization raises through Communities Foundation of Texas NTX Giving Day will go directly towards my organization’s mission/programs/services/beneficiaries located within the 20 county North Texas region as defined by the NTX Giving Day eligibility rules.
  
  
• I certify that my organization will use NTX Giving Day proceeds for fully charitable and tax-deductible purposes per the IRS and that donors to my organization will not purchase memberships, tickets, raffle tickets or any other item that could be viewed as a benefit for their donation.
  
  
• I certify that my organization will not encourage donors to fulfill commitments made to my organization made through a NTX Giving Day gift.
  
  
• I certify that my organization understands that the processing fee to participate in NTX Giving Day is 2.49% of all credit and debit card gifts.
  
  
• I certify that my organization understands that Communities Foundation of Texas has a 30-day verification period for NTX Giving Day donations and that final distribution amounts will be calculated at the end of the verification period.
  
  
• I certify that my organization understands that it is required to provide the organization’s ACH information to participate in NTX Giving Day. My organization understands the need and accepts full responsibility for providing accurate and appropriate ACH information ensuring the banking information is accurate and authorized. My organization understands that it is our responsibility to communicate with Communities Foundation of Texas any difficulty we experience in providing this information.
  
  
• My organization releases, discharges, and relinquishes Communities Foundation of Texas from any and all liability for relying on the ACH information we provide.
  
  
• I certify that my organization understands and accepts that we may need to refund granted amounts to Communities Foundation of Texas if a donor contacts Communities Foundation of Texas to issue a refund, or if the credit card company recalls the payment for any reason after we have received the ACH transfer of proceeds from Communities Foundation of Texas.
  
  
• I understand that important and urgent NTX Giving Day information will be posted on the NTX Giving Day social media pages (Facebook, Twitter, Instagram), and that our organization should follow those social media accounts to stay best informed.
  
  
• I certify that by participating in NTX Giving Day and any of its affiliated events, my organization, and all our representatives, consent to the recording of our likeness, image, and/or voice and authorize Communities Foundation of Texas to use photographs, video, and audio recordings containing our likeness, image, and/or voice in any medium for any purpose. • I certify that my organization accepts full responsibility and liability of any NTX Giving Day event, in-person or virtual, hosted by my organization and thus releases, discharges, and relinquishes Communities Foundation of Texas and its NTX Giving Day partners from any and all liability. Further, I certify that my organization will adhere to the relevant city, county and state guidelines for any gathering (whichever is strictest at the time of the event).
  
  
• I accept and acknowledge that any use of the NTX Giving Day name, logo or materials, in relation to any event or fundraising activity in which we participate or host is our sole responsibility and does not constitute any type of partnership, agreement with or liability for Communities Foundation of Texas and its NTX Giving Day.
  
  
• I certify that my organization understands that we have the opportunity to purchase supplemental products offered by Mightycause, the technology provider for NTX Giving Day, and that my organization understands and accepts that we are under no obligation to purchase any additional Mightycause products beyond payment of the NTX Giving Day registration fee.
  
  
• I certify that my organization understands that as a registered participant of NTX Giving Day, our organization may receive funding through campaigns run outside of NTX Giving Day in September. My organization understands that the NTX Giving Day platform operates in a year-round fundraising capacity and that there is no separate registration cost and platform fees remain the same at 2.49%.
